Terms of Use and Disclaimer
1. Definitions
1.1 Company means HONG KONG XINRUIBAI TRADING CO., LIMITED, a company incorporated and operating in Hong Kong, including all official sales channels, online stores, social commerce platforms and offline retail channels.
1.2 Customer means any individual or entity that purchases, orders or uses the Companyโs womenโs apparel products.
1.3 Products mean all womenโs clothing and matching accessories sold by the Company, including but not limited to dresses, tops, trousers, skirts, knitwear, outerwear and fashion accessories.
1.4 Contract means the legally binding sales agreement formed upon successful payment and order confirmation between the Company and the Customer.
2. Product Description & Usage Rules
2.1 All Products comply with Hong Kong apparel safety and sales standards. Product size, fabric, design, colour and care instructions are subject to the official product tags and delivered physical goods.
2.2 Minor colour difference, shade deviation and slight size tolerance caused by lighting, shooting angle, display screen difference or manual measurement are normal industry phenomena and do not constitute quality defects or valid return reasons.
2.3 The Customer shall use and maintain all Products in accordance with the washing and care instructions labelled on each product. Improper use including but not limited to machine washing delicate fabrics, excessive scrubbing, high-temperature ironing, long-term sun exposure, prolonged soaking and unauthorized modification may cause deformation, fading, snagging or damage. The Company shall not be responsible for any damage caused by improper customer maintenance or human factors.
2.4 All Products are for personal daily wear only. Commercial use, including product rental, resale, stage performance high-frequency wear, commercial shooting and secondary modification for business purposes, is strictly prohibited. Any damage or legal dispute arising from unauthorised commercial usage shall be borne solely by the Customer.
3. Order, Payment & Pricing
3.1 An official sales contract takes effect after the Customer completes full payment. The Company will arrange product delivery or in-store collection according to confirmed order information.
3.2 The Customer shall ensure all order information, including recipient name, contact number and delivery address, is accurate and complete. The Company shall not be liable for missing delivery, wrong delivery or delayed delivery caused by incorrect customer information.
3.3 In case of incorrect pricing due to system failure, manual input error or technical malfunction, the Company reserves the right to correct the price or cancel the unshipped order with a full refund to the Customer, without additional compensation or liability.
4. Return, Exchange & After-Sales Policy
4.1 Valid Application Period: Customers may apply for return or exchange within 7 calendar days from the date of purchase or goods receipt, in compliance with the Hong Kong Sale of Goods Ordinance (Cap. 26).
4.2 Valid Return & Exchange Conditions: Products must be brand new, unworn, unwashed, undamaged, free of stains, odours and snags, with original tags, packaging and complete accessories intact and resalable.
4.3 Quality Defect Warranty: For products with genuine factory defects including broken stitches, fabric flaws, severe damage and significant inconsistency with official descriptions, the Company provides free repair, exchange or full refund within the valid after-sales period. Relevant delivery fees for quality issues shall be borne by the Company.
4.4 Non-Returnable & Non-Exchangeable Circumstances:
(a) Products that have been worn, washed, altered, stained, worn out or artificially damaged;
(b) Products with missing, damaged or removed original tags and packaging that affect resale;
(c) Unsuitable size, personal style dislike, subjective colour difference perception and other personal preference reasons;
(d) Clearance, discounted, flash sale and custom-made products;
(e) Applications submitted beyond the 7-day valid after-sales period.
4.5 All return and exchange applications must be accompanied by valid transaction proof, including order records, payment receipts or official sales slips.
5. Warranty & Liability Limitation
5.1 The Company warrants that all apparel products conform to normal quality standards for daily wear and have no hidden factory defects under normal usage.
5.2 The Company provides after-sales support for non-artificial quality faults occurring under normal wearing conditions, including free repair, exchange or partial refund at the Companyโs discretion.
5.3 Natural wear and tear, minor pilling, slight wrinkles and normal usage traces caused by long-term wearing are regarded as normal consumption and do not belong to quality defects.
5.4 The Company shall not be liable for any indirect loss, incidental loss, economic loss or consequential damage arising from improper product use, customer matching problems or subjective experience issues.
6. Intellectual Property Rights
6.1 All product designs, pattern graphics, copywriting, pictures and visual content published by HONG KONG XINRUIBAI TRADING CO., LIMITED are protected by Hong Kong intellectual property laws.
6.2 No individual or institution may copy, reproduce, screenshot, modify, disseminate or use the Companyโs intellectual property content for commercial purposes without written official authorization.
6.3 The Company reserves the right to pursue full legal liabilities and compensation for any intellectual property infringement acts.
7. Personal Data & Privacy Protection
7.1 The Company strictly complies with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486). All customer personal information, including order data, contact details and personal identity information, will be kept confidential and properly stored.
7.2 Customer personal data is only used for order processing, delivery arrangement, after-sales follow-up and member service management. The Company will not disclose, sell or share customer private information to third parties without explicit customer consent.
8. Governing Law & Dispute Resolution
8.1 These Terms and Conditions and all sales contracts are governed exclusively by the laws of the Hong Kong Special Administrative Region. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
8.2 Any dispute, conflict or claim arising from product transactions, product usage and after-sales services shall first be resolved through friendly negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the Hong Kong SAR courts.
9. Amendment of Terms
9.1 HONG KONG XINRUIBAI TRADING CO., LIMITED reserves the right to update and revise these Terms and Conditions at any time without prior notice.
9.2 Updated terms shall take immediate effect upon official publication on sales channels. Continuous purchase and use of the Companyโs products after update publication constitutes acceptance of the latest terms.
